(subsequently referred to as the Guesthouse)
1. Guesthouse Policies1.1. The reserving of rooms and apartments, and the arranging of all other deliveries and services, become binding in of themselves and for the guest/booker with the confirmation from the Guesthouse. Each booking entitles the Guesthouse to request an advance payment befitting the booked room and/or object.
1.2. The letting of the rooms or apartments establishes a rental relationship. Any subletting or subsequent renting requires the written consent of the Guesthouse. The Guesthouse fundamentally retains the right to decide how the spaces are distributed.
1.3. When making a booking the guest must tell the Guesthouse the conclusive number of people planning to use the rented object and list them by name. No reduction is granted when fewer than the originally agreed upon number of people arrive. Accepting a larger than agreed upon number of people is not allowed, except in special cases where the guest consults the Guesthouse beforehand and pays an increase in the price of accommodation. When differences in the number of people occur, the Guesthouse retains the right to make other arrangements for the rooms or apartments.
1.4. If a booking by the guest cannot be used, without the Guesthouse being at fault, this reserves the demand to pay the agreed upon rent. Depending on when the booking is cancelled, and on which additional services, especially gastronomical services, were planned, the Guesthouse is entitled to an appropriate reimbursement fee. The amount of the rent and reimbursement result from the Guesthouse’s confirmation of order as mentioned in Provision 1.1..
1.5. With respect to the Guesthouse, the guest will vouch for any property loss or damages caused either by himself/herself or by traveling companions, as well as for property loss or damages caused by guests of the guest. To avoid any damage to the walls, the hanging of decorations or other articles is strictly forbidden. Only in cases where the Guesthouse is at fault does it become liable for lost or damaged items brought along by guests.
1.6. Insofar as the Guesthouse obtains technical and other furnishings for the guest from a third party, it operates in the name and at the expense of the guest. The guest is solely responsible for handling these furnishings with care and returning them properly. The guest’s full liability for the furnishings exempts the Guesthouse from any demands of a third party.
1.7. The guest is fundamentally allowed to bring food and beverages into the rooms and/or apartments and consume them there. In the rooms, preparing warm meals, cooking, and the boiling of water are not allowed. For this purpose the Guesthouse’s own kitchen is available. The guest is solely responsible for any violations or possible consequences the result of his/her own negligence.
1.8. The rooms and apartments may not be used for celebrations or events of any kind – for example parties, commercial events, or other private/commercial gatherings which contradict the intended use of the rented space. Also prohibited is every usage of the space which endangers the security of the Guesthouse and/or harms its reputation. In the event of such violations the Guesthouse can demand a financial compensation.
2. Room Reservations2.1. Through the confirmation issued by the Guesthouse, a housing contract goes into effect. The contract partners are the guest and the Guesthouse.
2.2. Completing the housing contract obliges the contract partners to fulfill their reciprocal obligations throughout the entire duration of the contract. If the booker and the guest are not the same person, the booking party will carry all the costs and duties.
2.3. If the room reservation is not used in the event of a change of travel plans or cancellation, the Guesthouse is entitled to present a bill covering the financial loss or cancellation costs. In such cases the cause for not using the reservation is irrelevant.
Reservations must be fundamentally guaranteed with a VISA/MASTERCARD or money transaction. When no credit card is available, the full amount for the desired period of accommodation must be transferred to the account of the Guesthouse. In this case the Guesthouse must be contacted in advance. There is no charge to your credit card when making a reservation. A charge only occurs when handling the described CANCELLATION procedure. The Guesthouse accepts VISA/MASTERCARD. When registering at the Guesthouse, the fee for the room is paid in full. You can pay with credit card, EC-Card (Maestro), or in cash.
2.4. The financial loss or cancellation fee is calculated from the price of the negotiated room or apartment minus the economizing fees carried by the Guesthouse as a result of the space not being used. We do not make provisional reservations. Confirming a booking entitles the Guesthouse to deduct as a down payment from the booker’s credit card a sum that corresponds with the amount of an overnight stay. When a booking is made the booker/guest gives his/her expressed consent to this procedure. In the event of a cancellation up to 14 days before an arrival, we keep the sum of the down payment debit as a handling fee. If you cancel your booking less than 14 days (but at least 7 days) before your arrival, we will calculate as a cancellation fee 80% of the price of the already-booked period of accommodation. In the case of later cancellations or no-show situations, the cancellation fee is 100% of the full price for the room within the booked time period, and this amount is deducted from your credit card.
2.5. When room reservations are not used before 6 p.m., the Guesthouse retains the right to rent the room to another guest provided no other time of arrival is arranged. If no renting to another party occurs, the right to a further renting does not rule out a financial loss or cancellation fee.
2.6. Provision 2.4. also applies to group reservations. The booker is without restriction financially liable for his/her booking, whether he/she books for himself/herself alone or for several people. Advance payments not made within the designated time span, or rebooking the payment by credit card, lead to an annulment of the housing contract, whereby the Guesthouse retains the right to market the rooms elsewhere, without the booker or the guest being eligible for a financial compensation from the Guesthouse. If no further renting occurs the Guesthouse is entitled (as mentioned in Provision 2.4.) to present a bill that covers the financial loss or cancellation costs. The basis of the calculated costs is the time at which the respective further renting of the space takes place. A free of charge cancellation is only possible if this occurs up to 6 weeks before arrival, and if no other details were arranged. The deciding factor here is the receipt of the cancellation at the Guesthouse.
3. The Online Service3.1 Contents of the Online Service
The author by no means fully guarantees the currentness, correctness, completeness, or quality of the information made available online. Any legal actions against the author related to damages of a material or non-material nature, caused by the use or nonuse of the presented information or by faulty or incomplete information, are herewith deemed fundamentally inapplicable, insofar as no provable blame, whether caused intentionally or through gross negligence, is attributed to the author. All the posted offers are obliging and subject to alteration. The author retains the expressed right to alter the pages either in part or in their entirety, and to complement, delete, or end the publication altogether, whether for short periods of time or conclusively.
3.2. References and Links
n the case of direct or indirect references to foreign Internet pages (“links”) which lie outside of the author’s area of responsibility, an exclusive obligation to act responsibly goes into effect, in which the author expresses his awareness of the contents and deems it reasonable to hinder any usage that involves the accessing of illegal contents. Herewith the author expressing declares that no connections to pages with illegal contents were recognizable at the time of setting up the links. The author has no control over the current and future design or contents and authorship of the linked/connected pages altered after the setting of the links. For this reason he fundamentally disclaims himself from the contents of all the linked/connected pages altered after setting up the links. This assessment not only applies to all the established references and links of his own Internet service, but also to all the foreign entries that appear in the guest books, discussion forums, and mailing lists set up by the author himself. Solely responsible for any illegal, faulty or incomplete contents, and especially for damages caused by the use or nonuse of such presented information, is the supplier of the page to which it refers, and not those who the respective publication merely refers to via the links.
3.3. Authorship and Distinguishing Label Rights
In all the publications the author commits himself to complying with the employed copyrights of the graphics, audio documents, video sequences and texts; to using graphics, audio documents, video sequences and texts he himself sets up, and to falling back on graphics, audio documents, video sequences and texts not under license.
Every brand name and trademark referred to within the Internet service and, should it arise, protected by a third party, is without restriction liable to the requirements of the respective and valid, distinguishing label rights as well as to the proprietary rights of the respective registered owner. The naming of trademarks alone does not presuppose that they are unprotected by the rights of a third party!
The copyrights for the published objects set up by the author lie solely with the author of the pages. Any copying or further use of these graphics, audio documents, video sequences and texts in other electronic or printed publications is strictly forbidden without the expressed permission of the author.
3.4. Data Protection
Insofar as this Internet service entails entering personal or business-related data (E-mail addresses, names, postal addresses), the user submits this data on a strictly voluntary basis. The utilizing of and paying for all of the offered services – as far as technically possible and feasible – is also allowed without submitting such data, as for example by using anonymous data or a pseudonym.
3.5. The Legal Effectiveness of this Liability Exclusion
This liability exclusion is to be viewed as part of the Internet service and referred to from this page. If parts or individual formulations of this text do not comply with the applicable legal position or no longer correspond in full, this does not effect the content and validity of the other parts of the document.
4. Other Guesthouse Conditions4.1 Minimal Periods of Residency
If you wish to stay at the Guesthouse on a high-season weekend, the minimum period of residency is 3 nights. This can be either a Thursday, Friday and Saturday residency period OR a Friday, Saturday and Sunday residency period. On holidays and on weekends during special events, such as New Year’s Eve, The Easter Meeting, Christopher Street Day Berlin (CSD), The Motz Street Festival, The Berlin Film Festival (Berlinale), The International Tourist Fair (ITB), etc., there is a surcharge of EURO 10,- per night. Please see the high-season periods as posted in the online occupancy plan.
4.2 Check-in
Check-in is from 2 p.m. to 10 p.m.. If you wish to check-in later or earlier, this is possible by consulting the Guesthouse in advance. In general, we kindly request that you inform us of your planned time of arrival.
4.3 Check-out
Check-out is no later than 12 noon. A later check-out can be arranged provided the room is not being rented again immediately.
4.4. Other Particulars
Any damages resulting from the inappropriate treatment of the furnishings will be charged to the guest. All the rooms contain a NOTEBOOK with free of charge Internet access. If the NOTEBOOK is damaged, whether out of negligence or deliberately, or stolen or damaged by a third party, the resulting costs are charged to the guest and deducted from his credit card. All the rooms contain a MINI BAR and a telephone with an individual number. The bill is handled during check-out. If your Guesthouse keys are lost, we charge a fee of EURO 25,- per key.
